Terms of use

Purpose

These terms govern the use of the public website spotonloc.com: browsing the listings, sending a rental request, the tenant portal and logging in to your account. By using the website, you accept them.

They do not cover the lessor subscription. It is sold by A Zesty Solution SRL under its general terms, available at https://www.azestysolution.com/terms.

Who is who

Spot on Loc is a rental-management service. The website is operated by A Zesty Solution SRL, Rue Prairie Coppée 23, 7110 La Louvière, Belgium (company number 1017434384).

Lessors are the owners or managers of the units. They use Spot on Loc to manage their units and their leases. Tenants and candidates are the people who rent, or want to rent, a unit.

A Zesty Solution SRL is not an owner, not a real estate agent and not a party to the lease.

Listings

Each listing is published by a lessor, under the lessor's responsibility. The lessor decides which unit is offered, the rent, the charges, the rental deposit, the availability date and the rental conditions.

We do not check each listing. Photos and descriptions are given for information. A unit may already be rented even if it still appears on the website. For any detail about a unit, contact the lessor.

The rental request

The request form lets you tell the lessor that you are interested in a unit. It creates a file in the name of the lessor concerned and alerts the lessor's team by email.

A request is not a reservation. It creates no contract and does not guarantee that the unit will be rented to you. The lessor remains free to follow up on it or not.

The lease is signed between the lessor and the tenant, under the rules that apply to leases. A Zesty Solution SRL is not a party to this lease.

The information you give must be accurate and must concern you. Attach only the documents that are useful for your request. The lessor will then tell you what is needed to prepare the lease, for example proof of income or an identity document.

The tenant portal account

The lessor may invite you to create an account on the portal. The account is personal. You are responsible for your username and your password, and you do not share them with anyone.

If you think someone else is using your account, write to us without delay. We may suspend an account if its security is seriously in doubt, or if it is used against these terms. The account ends when the lease ends, according to the lessor's instructions.

Acceptable use

You agree not to:

  • extract the content of the website automatically (scraping, bots);
  • send false requests, or requests in the name of another person;
  • publish or send content that is unlawful, abusive or misleading;
  • try to access data that does not concern you, or to disrupt the website;
  • use the website to send unsolicited advertising.

We may remove content or block access that does not follow these rules. If you see an abusive listing or content, report it to contact@spotonloc.com.

Availability of the website

We do what is needed to keep the website accessible, but we do not guarantee continuous, error-free access. The website may be interrupted for maintenance, a failure or an outside cause. We may change or remove a feature of the website.

Liability

To the extent permitted by law, A Zesty Solution SRL is not liable for:

  • the content of the listings or the decisions of the lessors;
  • the relationship between the lessor and the tenant, the lease and its performance;
  • interruptions of the website or data losses that are not our fault;
  • indirect damages.

For other damages, our liability is limited to direct and foreseeable damages.

Nothing in these terms excludes our liability for fraud or gross negligence, or removes the rights that the law gives you as a consumer.

Intellectual property

The Spot on Loc name, the logo, the texts and the images of the website belong to A Zesty Solution SRL or to their owners. The contents of the listings belong to the lessors. You may browse the website for your personal use. Any other use requires written consent.

Personal data

The processing of your data is described in the privacy policy.

Lessor subscription

The lessor subscription to Spot on Loc is a separate contract. It is sold by A Zesty Solution SRL under its general terms (https://www.azestysolution.com/terms), in which the French version prevails over the English one. These terms of use do not apply to it.

Changes to the terms

We may change these terms, for example if the service or the law changes. The current version is the one published on the website, with its date. The new version applies from its publication. If you do not accept it, you stop using the website.

Governing law and courts

Belgian law applies to these terms. In case of a dispute, the courts of Hainaut have jurisdiction. If you act as a consumer, you keep the benefit of the mandatory rules that protect you, including those on the choice of court.

If the French and English versions differ, the French version prevails.
